How much does a divorce cost in Victoria?

The divorce itself is a relatively small, fixed court process — most of the cost comes from sorting out property and parenting. Here’s how it works, and how we keep it clear.

Divorce & separation

In Australia the divorce order simply ends the marriage — the court filing fee is fixed, and if you and your ex-partner agree, the legal cost is modest. What drives cost is dividing property and agreeing parenting arrangements, which are separate legal matters that run alongside the divorce.

What actually costs money

An agreed divorce is inexpensive. Disputes over property or children cost more because they need negotiation, family dispute resolution (mediation) and sometimes court. The more you and your former partner can agree, the less the whole process costs — which is why we push hard for sensible agreement wherever it’s possible.

Reducing the cost

Reaching agreement on property and parenting through negotiation or mediation is almost always cheaper and faster than a contested court case. We’ll also tell you if you may be eligible for Victoria Legal Aid, and point you to free support services where they’re appropriate.

Where to start

Book a consult and we’ll map out your situation, what’s likely to be involved, and the most cost-effective path forward — usually agreement or mediation rather than a courtroom.
